Rules for the use of the electronic donation system

M. ROSTROPOVICH CHARITY AND SUPPORT FOUNDATION „RULES FOR THE USE OF THE ELECTRONIC DONATION SYSTEM OF “AID FOR CHILDREN'

1. General provisions

1.1 These Rules for the Use of the Electronic Donation System (hereinafter referred to as the „Rules“) set out the conditions and procedures for donating to the M. Rostropovičius Charity and Support Foundation "Help for Children" (hereinafter referred to as the "Foundation") through the Foundation's website or through any other electronic channels used by the Foundation.

1.3 By donating via the Foundation's website (the "Website"), you acknowledge that you have read, understood and agree to be bound by these Terms and Conditions.

1.4 Donations to the Foundation shall be considered as gratuitous donations made in accordance with the Civil Code of the Republic of Lithuania and other applicable legal acts.

2. Who can donate

2.1 Donations to the Foundation are open to natural and legal persons.

2.2 A natural person may make a donation only if he/she has the right to enter into binding transactions in accordance with the legislation of the Republic of Lithuania (Article 6.476 of the Civil Code of the Republic of Lithuania).

2.3 Persons under the age of 18 may donate only with the consent of their parents or other legal representatives.

2.4 By clicking the „Donate“ button, you confirm that:
- you are at least 18 years old; or
- you have the consent of your legal representatives to make the donation.

3. SMethods of donation

3.1. a single donation can be made at the veta.

3.2 The amount of the donation shall be chosen by the donor and charged once to the payment instrument chosen by the donor.

3.3 Donors are required to provide true and accurate information when completing the donation form.

4. Payment methods

4.1 Donations may be made through the Foundation's payment collection system, which may be provided through SEB Bank or other licensed payment service providers.

4.2. Available payment methods:

  • payment initiation service (MIP) via e-banking;
  • Visa and MasterCard payments;
  • payments with Apple Pay;
  • Google Pay payments;
  • payments via e-banking (e.g. SEB, Swedbank, Luminor, Citadele, Šiaulių bankas, etc.).

4.3 Payment transactions shall be executed by the payment service provider selected by the auctioneer and the auctioneer may be subject to the terms and conditions of the relevant service provider.

4.4 All donations shall be made in Euro (EUR).

5. Payment confirmation

5.1 The donation process shall be deemed to be completed when the payment service provider confirms the payment transaction.

5.2 The Auctioneer may receive confirmation of the payment in his/her banking system or by email, if such function is provided.

6. Return of donations

6.1 Donations shall be considered as gratuitous donations to the Foundation.

6.2 Donations are non-refundable unless:

  • the payment was due to a technical error;
  • the payment was made without the payer's consent;
  • required by applicable law.

6.3.The Auctioneer may contact the Foundation at the contacts specified in Clause 1.2 of these Terms and Conditions in case of possible payment errors.

7. Payment security

7.1 Payments shall be made using secure payment service provider systems.

7.2 The Foundation does not store donors' payment card data.

7.3 Payment transactions may be additionally authenticated using methods that meet the requirements of PSD2 Secure Authentication (SCA).

8. Responsibility

8.1 The Auctioneer is responsible for the accuracy of the data provided.

8.2 The Foundation shall not be liable for:

  • disruptions in the systems of banks or payment service providers;
  • internet interruptions;
  • incorrect data provided by the donor.

8.3 The payment service provider shall be responsible for the execution of the payment transaction.

9. Protection of personal data

9.1 The personal data of the Auctioneers shall be processed in accordance with the General Data Protection Regulation (GDPR) of the European Union and the legislation of the Republic of Lithuania.

9.2 Further information on data processing is contained in the Foundation's Privacy Policy.

10. Modification of the Rules

10.1 The Foundation shall have the right to amend these Rules at any time.

10.2 The latest version of the Rules shall be published on the website of the Fund.
